These SportsMax FREEmium Terms and Conditions (the “Terms”) apply to you and govern your access to the SportsMax FREEmium Content (including the Free and Premium Content, collectively referred to as the “Content”) through our website (https://www.sportsmax.tv/) and mobile application (collectively referred to as the “App”). You should read these Terms carefully before registering and subscribing to a payment plan to access this Content.

“We” or “us” means International Media Content Limited, a company registered under the laws of St. Lucia and the registered office of which is at PO Box BW400, Baywalk Mall, Rodney Bay Castries, St Lucia, including our subsidiary SportsMax Limited, a company registered under the laws of Jamaica and the registered office of which is at 22 Chalmers Avenue, Kingston 10, Jamaica.

 “You” means the person accessing or using the App or viewing its Content (and “your” shall have the same meaning).

By accessing or using the App, whether occasionally, frequently or permanently, or by otherwise indicating your consent, you agree to be bound by these Terms.

If you do not agree to or accept any of these Terms, you should stop using this App immediately.

  1. The SportsMax FREEmium content allows access to certain Content on the App and are available to all App users and subscribers.

 

  1. To access the App, you may either download the application to your mobile device or use the website on your internet browser.

 

  1. To access the Content, create an account on the App and sign in.

 

  1. Once you have an account, you have access to the Free Content. This allows you access to over 300 hours of live sporting content per month and over 150 hours of content pieces per week.

 

  1. To access Premium Content you must be an existing Digicel subscriber on an active plan or you can also purchase the Sportsmax Premium content package directly from your relevant App store. If you have upgraded to a paid Premium Plan, this will renew automatically every month and the automatic charge will be made to the same payment method until you choose to change it.

 

  1. When you are close to the end of your monthly Premium Plan, you will be notified so that you can prepare to be charged for renewal or opt out of automatic renewal.

Digicel Customers

  1. If you are an existing Digicel subscriber on an Active Plan you will have access to both Free and Premium content at no additional cost until March 31, 2020.
  2. If you are a Digicel customer, you may choose to access your Premium Content either:
    1. via the App or your App Store with your credit or debit card; or
    2. via the MyDigicel Application.

 

  1. The monthly price for your Premium Content may be found on:
    1. your App Store if you are paying with credit or debit card; or
    2. the Digicel website of your country if you are paying with credit.

 

  1. You may check the details of your Active Plan change your payment method, cancel your Premium Content (downgrade to Free content only), or upgrade from Free to Premium, at any time, by managing your subscription on the App or via the MyDigicel Application.

 

  1. You accept that, if you port your number or if the number used for the subscription is found to no longer be a Digicel number, your premium subscription will be immediately terminated. In this case, you will be able to create a new account and follow the steps as a Non-Digicel Customer.

 

  1. In addition to these Terms and Conditions, you remain bound by any other terms and conditions of use for any of our other services including but not limited to the terms and conditions for Digicel’s Prepaid and Post-paid mobile telephone and data services, the Terms and Conditions of the App and the Terms and Conditions of the MyDigicel Application.

 

  1. Please note that this subscription is not a “Chargeable Event” as defined in Digicel’s Prepaid terms and conditions. This means that if you are a prepaid Customer and do not make or receive any calls using the Digicel number used for the Content for 120 days or more, you may lose your number.

 

  1. For customer support, or to report a problem or send us your feedback, please contact us through the customer support chat feature on the MyDigicel Application or visit the “Contact Us” option on the App.

Non-Digicel Customers

  1. If you are not a Digicel customer, you may pay for your Premium Content on the App or your App Store with your credit or debit card. The monthly price for your Premium Content may be found on the App Store.

 

  1. If you are signing into the App for the first time, you will be allowed access to the Premium Content for thirty (30) days from the date of signing in (“Intro Free Period”). This allows you access to all the Free content as well as access to Premium Content. After the thirty-day (30) Intro Free Period is complete, you will automatically have access only to the Free Content and the Premium Content will only be accessed at a cost.

 

  1. You may check the details of your content package, change your payment method, cancel your Premium Content package (downgrade to Free content only), or upgrade from Free to Premium, at any time, by managing your subscription on the App.

 

  1. In addition to these Terms and Conditions, you remain bound by the Terms and Conditions of the App.

 

  1. For customer support, or to report a problem or send us your feedback, please visit the “Contact Us” option on the App.

Additional Terms and Conditions

(All Customers)

  1. This product is offered for your personal use and not for commercial use.

 

  1. You are solely responsible for all associated fees and costs incurred by you for connectivity and data usage in relation to your use of the App. Be reminded that once roaming, you will not be able to use any data from your local prepaid or select postpaid Content.

 

  1. We reserve the right to terminate this offer if, in our sole opinion, the Content are being abused, such abuse to include but not be limited to reselling or attempts to resell the content, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

 

  1. We reserve the right to modify or discontinue (permanently or temporarily), this plan being offered to you at our discretion.

 

  1. We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this product. In the event of us giving notice to you of any such changes to or cancellation of the Service, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

 

  1. You accept that certain content on the App may not be available in your country or in your preferred language due to contractual licensing restrictions. Please note that content available in your current location may become unavailable to you if you travel to another location in which content is restricted.

 

  1. The terms and conditions which apply to any plan are those published on the App at the time that you activate your plan. These will only apply for the plan duration. If you manually or automatically activate a plan that you have previously activated, then the terms and conditions that apply are those published at the time of your most recent activation.
